COMPETITION LAW
There are two sides to competition law in our practice. The first one relates to forbidden agreements and market practices aimed at limiting competition. The second one concerns a ban on acts of unfair competition. Even a small company may conclude an agreement violating anti-monopoly laws, in particular if it operates in a market niche. Each company must keep an eye on its competitors to check whether they play fair and monitor its own activities for compliance with the law. A lawyer who does not understand business is powerless in such cases. We understand business.
We have extensive knowledge and experience in competition law. We provide legal assistance in this area e.g. on the following issues:
- conducting litigation in the area of unfair competition
- issuing opinions on the compliance of companies’ operations with the Polish and European competition law (including sector-specific solutions, e.g. Automotive Block Exemption Regulation)
- representing our Clients in the proceedings before the Office of Competition and Consumer Protection and in court proceedings
- preparing agreements, in particular distribution agreements, taking into account the issues of exclusivity and other issues regulated by the anti-monopoly laws
- issuing opinions on compliance of the activities of industry organizations and other associations of entrepreneurs with the competition law.
Major projects completed by our team include:
- successful completion of a court dispute concerning an act of unfair competition involving distribution of false information about another entrepreneur
- preparation of a legal opinion – a comprehensive analysis of the internal regulations of a major Polish industry organization aimed at identifying the changes that are necessary to avoid accusations of restricting competition
